  • Tenth Amendment Movement, State Rights, Returns to California

A major portion of the Tea Party movement is based on the Tenth Amendment to the Constitution.

"Political waters are boiling all across America, including California. One of the areas this is happening is the Tenth Amendment Movement, which takes seriously the last of the Bill of Rights, which reads: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The fight against Obamacare surrounds the 10th Amendment. The legalization of marijuana is based on the Tenth as well.

"Another movement is the Tenth Amendment Center, which ranks third in Googles rankings under Tenth Amendment, behind the usual Wikipedia entry and FindLaws entry. Most of its issues defy easy left/right dichotomies. For instance, the Center recently has been defending state raw milk laws, commonly associated with leftish health enthusiasts, against assaults from the federal FDA.

But it also defended Arizonas recent controversial immigration law against claims that only the Feds have jurisdiction over immigration."

Gun laws, like the Federal Brady bill, violate the Tenth Amendment. This is what happens when you have Supreme Court Justices that believe in a "social" Constitution, a "living" constitution, instead of the original Constitution.

America troubles start when make policy based on totalitarian principles, not Constitutional principles.
