  • State lawmakers kibitz US Senate on Immigration

When California citizens demanded immigration checks on criminals, Many in the state legislature hacked up the old "immigration is a federal matter" sidestep. But the hypocrisy we see so often coming from the state house surfaced again in a letter to her majesty the queen of California, Dianne Feinstein, from the latino lobby.

California Assembly Speaker Núñez and Los Angeles Mayor Villaraigosa Urge Senator Feinstein to Oppose an Amendment to the Senate Immigration Bill that would Endanger Day Laborer Centers

SACRAMENTO – Assembly Speaker Fabian Núñez (D-Los Angeles) and Los Angeles Mayor Antonio Villaraigosa today sent the following letter to Senator Dianne Feinstein after learning of efforts to include in the Senate immigration bill an amendment that would preempt local land use decisions regarding designated areas for day laborers. The amendment has been opposed by labor groups, immigrant rights groups, and the Los Angeles City Council and would endanger day laborer centers throughout California.

    “May 25, 2007

    “Honorable Dianne Feinstein

    331 Hart Senate Office Building
    Washington, D.C. 20510

    “Dear Senator Feinstein:

“It has come to our attention that efforts are being made to include an amendment in the Senate immigration bill that would preempt local land use decisions that require a business to provide a designated area for use by day laborers.

“We urge you to oppose the inclusion of any such amendment.

“In our home city of Los Angeles, 11 business-funded day labor sites have proven to be an effective way to protect customers, their families, and laborers at home improvement warehouses and other businesses that draw large numbers of individuals congregating in search of work.

“These sites also work to mitigate the impact new home improvement warehouses have on existing neighborhoods by limiting the scope of where and how day laborers and the customers wanting to hire them can connect.

“We understand some companies may have expressed a concern to you about their financial liability regarding day labor sites. They might do well to consider their potential liability from injuries or accidents that could occur in their parking lots and driveways should a federal preemption leave it so workers would simply move in and around cars and customers to match up with those seeking their labor.

“The land use decisions made by the City of Los Angeles in these situations are the result of strong local review based on local information and local needs. Federal preemption should not be used to take away this effective local tool.

    “Sincerely,

“Speaker Fabian Núñez & Mayor Antonio Villaraigosa”
