  • Ban The Fireplace Burn Bans

    My fellow Sacramentan's. The state and its' subdivisions are stealing your culture, freedom, and independence. This county and it's parent, the state of California are trying to take away a basic cultural practice that has been part of our heritage since this state joined the union. I'm referring to the banning of home fires in fireplaces. They are doing this under the guise of cleaner air, but really, that is a false front. This county and this state keep on approving further growth, which is at the core of air pollution, and not home fires. In addition, the counties are enacting punitive measures to enforce their will upon us through administrative law. Administrative law is basically a throwback to the kings common law, whereby you get none of your constitutionally protected rights. Yes, that's correct; You have no right to a trial by a jury of your peers, or even an impartial judge. Instead, you are redirected to a hearing officer that will be both prosecutor and judge. To add insult to injury, you are first adjudged guilt, and at your first hearing, you are appealing that guilt ruling. An appeal is not the same as a primary trial, and even less of your constitutional rights are allowed.

    So this county is basically demanding you give up your culture, your warmth, and your cheap utility simply because they are unwilling to stop approving more development, and the only way left they can impact the air quality minutely is by imposing draconian limits on your persnal life and home.

    It's time we fight this thing. They following up on reports by neighbors at this point, but they have said they have or will be doing patrols to cite people. Take a look at a recent quote from another article in San Joaquin county, the next one south of us, is doing:

    Since 2003, the San Joaquin Valley Air Pollution Control District has targeted fireplace soot as biggest source that is easiest to end and calls "no burn days" based on weather forecasts.
    Fires were banned on nearly every day in December, including Christmas Eve and New Year's, and the 60 people who patrol neighborhoods writing citations to offenders have been busy. Violations doubled in some areas and were up to five times higher in others last month as the district cracked down during unseasonably cold weather.
    "When we have weather conditions like this, there is nothing we can do really to meet the federal standards," said Seyed Sadredin, executive director of the district. "Even if we shut down I-5 and (U.S. Highway) 99 and shut businesses we would still violate the standard because there's no dispersion. The best we can do is to minimize the damage, and the best way to do that is with the fireplace rule."

    If you look at the fine structure on the SMAQB website, the first fine is $50.00. That's bad enough of course, but what's insulting is that after that, they just say they can determine the amount of your fine by the supposed damage you've done to the air quality. Basically, the sky's the limit.

    They are after an all out ban of home fireplaces, and to cite my evidence, of that, it is now against the building codes here to construct a new hearth fireplace when building or rebuilding your home. In addition, they offer vouchers to upgrade to an EPA approved fireplace insert or stove, but you must agree not to burn on the days that only those types of units are allowed to burn. That says they want you to burn less, not burn cleanly.

    This is an infringement on our lives, and one I believe the county should not be participating in, even as mandated by the state. This state doesn't enforce many of its' own laws, they release dangerous prisoners in our communities, and encourage illegal aliens to reside here and destroy our communities in many ways...and we are supposed to bend over when they want something from us? Hey! let's practice what they preach. No fines for fireplace users. If the state can exempt illegals from vehicle seizures, they sure shouldn't be siezing our money for this ridiculous crackdown and power grab

    Let's ban the burn ban!
